Timesharing (Child Custody)

In the majority of divorce actions, the parties agree to and/or are awarded by the court SHARED PARENTAL RESPONSIBILITY. Shared parental responsibility is a court ordered relationship in which both parents retain full parental rights and responsibility with respect to their child(ren). Both parents confer with each other so that major decisions affecting the welfare of the child(ren) will be determined jointly. In the event the parents cannot mutually agree on any applicable major decision, the court, as part of SHARED PARENTAL RESPONSIBILITY, can grant one parent ultimate decision making responsibility over various aspects of the child(ren)'s welfare. In rare cases, the court can order sole parental responsibility which means that one parent is authorized by the court to make all decisions regarding the minor child(ren).

A PARENTING PLAN regarding the parties child(ren) must be established in any divorce action. The PARENTING PLAN can be agreed upon between the parents and ultimately approved by the court. If the parents are unable to agree upon the PARENTING PLAN, then it will be established by the court.
The PARENTING PLAN includes various decision making parental responsibilities such as education, child care, extracurricular activities and healthcare related matters. The PARENTING PLAN also includes the timesharing entitlement of the parents, i.e. how much time the child(ren) spend with each parent.
